1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of paintersottawa.com (the “Site”) and any quote requests, bookings, estimates, invoices, or painting services provided by Ottawa Painters (“we,” “our,” “us”). By using the Site, requesting a quote, or booking services with us, you agree to these Terms. If you do not agree, do not use the Site or our services.

If a separate written quote, invoice, work order, or signed agreement applies to your project, that document will govern to the extent of any conflict with these Terms.

3. Estimates and Scope of Work

Any estimate or quote we provide is based on the information reasonably available at the time of inspection or discussion and is limited to the scope of work expressly described in writing. Unless stated otherwise, estimates are not guarantees of concealed conditions, additional repairs, or extra work discovered after the project begins.

Any start date, completion date, or project duration we provide is an estimate only unless we expressly guarantee it in writing.

4. Pricing, Taxes, and Payment

  • All prices are in Canadian dollars and are subject to applicable taxes, including HST, unless expressly stated otherwise in writing.
  • Any deposit, progress payment, and final payment terms for a project will be set out in the applicable written estimate, invoice, or work order.
  • We will not add mandatory charges beyond the written quote and applicable government taxes unless the customer approves the additional work or charge in writing.
  • If payment is overdue, we may pause unscheduled or future work, decline to book additional services, or delay non-essential follow-up until the account is brought current, where permitted by law.

5. Promotional Discounts and Offers

From time to time, Ottawa Painters may offer promotional discounts on qualifying projects, including fixed-amount offers such as $100, $150, or $200 off. Unless a specific written promotion expressly states otherwise, promotional discounts apply only to projects with a quoted subtotal of $2,000 or more before taxes.

  • The specific discount available to a customer is only the amount stated in the applicable written advertisement, estimate, coupon, email, text message, or other offer issued by Ottawa Painters.
  • A project meeting the $2,000 threshold does not automatically qualify for the highest available discount.
  • Only one promotional offer may be applied per project, household, or invoice unless we confirm otherwise in writing.
  • Promotions cannot be combined with other discounts, credits, referral offers, or special pricing unless expressly stated in writing.
  • Promotions must be presented or confirmed before booking or before the written estimate is accepted. They are not retroactive and have no cash value.
  • If the scope of work changes and the revised project subtotal falls below the qualifying threshold, or the original promotion no longer applies to the revised scope, we may remove or adjust the discount.
  • We may modify or discontinue promotions for future quotes at any time, but any discount already confirmed in writing for an accepted quote will apply according to that written offer.

6. Changes, Extras, and Unforeseen Conditions

Painting projects may reveal hidden or unexpected conditions, including water damage, rot, surface failure, mold, mildew, rust, structural issues, code-related issues, unsafe conditions, lead-based paint concerns, asbestos-related concerns, or other defects not visible during the initial estimate. Unless expressly included in writing, remediation of those conditions is not included in the original quoted price.

Any additional work, change in scope, upgraded materials, or remediation work may result in a revised price and schedule. Where we provide a written estimate for the agreed scope, we will not charge more than 10% above that estimate unless the customer approves additional charges or revised scope in writing.

7. Scheduling, Site Access, and Delays

  • Project scheduling depends on weather, site readiness, material availability, labour availability, and other conditions beyond our reasonable control.
  • Exterior projects may be postponed, interrupted, or extended because of weather, humidity, temperature, or surface conditions.
  • The customer is responsible for providing reasonable and timely access to the work area, electricity, water, washroom access where appropriate, and any required approvals, permits, parking access, elevator bookings, or permissions from landlords, property managers, or condominium corporations.
  • We are not responsible for delays caused by customer-requested pauses, restricted access, failure to make selections, site conditions, or events outside our reasonable control.

8. Customer Responsibilities and Approvals

  • The customer must provide accurate information about the property, surfaces, and requested work.
  • The customer is responsible for removing or protecting valuables, fragile items, electronics, artwork, and small personal belongings unless our written scope specifically includes moving or protection services.
  • Children, pets, and other occupants must be kept safely away from active work areas.
  • Colour, sheen, stain, and finish selections should be approved before materials are ordered or work begins on the relevant area. Digital images, samples, and prior jobs may appear different under different lighting or surface conditions.

9. Completion, Deficiencies, and Acceptance

A project will be considered substantially complete when the quoted scope has been performed, subject only to minor touch-ups, ordinary closeout items, or corrections that do not materially prevent normal use of the area. Minor touch-ups or punch-list items do not, by themselves, justify cancellation of the contract or withholding the full contract balance.

The customer should inspect the work promptly and notify us within a reasonable time of any specific deficiencies so that we can review and address covered items.

10. Warranty and Exclusions

Any workmanship warranty offered by Ottawa Painters will be limited to the warranty, term, scope, and exclusions expressly stated in writing for the particular project. Unless otherwise stated in writing, no separate or additional warranty is created by the Site, marketing materials, or verbal statements.

  • normal wear and tear
  • customer abuse, misuse, impact damage, or lack of maintenance
  • leaks, moisture intrusion, condensation, structural movement, settling, or substrate failure
  • pre-existing coating failure or conditions concealed beneath prior coatings
  • defects in customer-supplied materials or products
  • areas where the customer requested a deviation from our recommended preparation or coating system

Nothing in these Terms limits rights or remedies that cannot be excluded under applicable law.

11. Website Use and Intellectual Property

All content on the Site, including text, logos, graphics, photographs, design elements, and other materials, is owned by Ottawa Painters or used under licence and is protected by applicable intellectual property laws. You may not copy, reproduce, republish, distribute, or exploit Site content without our prior written consent, except for ordinary personal, non-commercial viewing.

You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or use the Site for unlawful, fraudulent, or harmful purposes.

12. Third-Party Links and Information

The Site may contain links to third-party websites, tools, or services. Those are provided for convenience only. We do not control and are not responsible for third-party content, policies, availability, or practices.

13. Limitation of Liability

To the fullest extent permitted by law, Ottawa Painters will not be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of profits, loss of business, loss of use, delay-related losses, or similar damages arising out of or related to the Site, our estimates, or our services. To the extent liability cannot be excluded, our total liability for a claim relating to a specific project or service will be limited to the amount actually paid to Ottawa Painters for that specific project or service giving rise to the claim.

This limitation does not apply to liability that cannot be limited or excluded under applicable law.

14. Privacy

Your use of the Site is also subject to our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page, and the Last Updated date will be revised accordingly. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of Ontario and the laws of Canada applicable in Ontario, without regard to conflict of law rules.
